Terms of Use
These Terms of Use govern your conduct associated with the Customer Ratings and Review service offered by Excelligence Learning Corporation (doing business as “Discount School Supply”) (the "CRR Service"). To the extent of any conflict between Excelligence Learning Corporation’s Privacy Policy and these Terms of Use, these Terms of Use shall control with respect to the CRR Service.
By submitting any content to Excelligence Learning Corporation, you represent and warrant that:
• you are the sole author and owner of the intellectual property rights thereto;
• all "moral rights" that you may have in such content have been voluntarily waived by you;
• all content that you post is accurate;
• you are at least 18 years old; and that
• use of the content you supply does not violate these Terms of Use and will not cause injury to any person or entity.
You further agree and warrant that you shall not submit any content:
• that is known by you to be false, inaccurate or misleading;
• that infringes any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
• that violates any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
• that is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation;
• for which you were compensated or granted any consideration by any third party;
• that includes any information that references other websites, addresses, email addresses, contact information or phone numbers; or
• that contains any computer viruses, worms or other potentially damaging computer programs or files.
You agree to indemnify and hold Excelligence Learning Corporation (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers, including but not limited to Bazaarvoice, Inc.), harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys’ fees, arising out of a breach of your representations and warranties set forth above, or your violation of any law or the rights of a third party.
For any content that you submit, you grant Excelligence Learning Corporation a, perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.
All content that you submit may be used at Excelligence Learning Corporation’s sole discretion. Excelligence Learning Corporation reserves the right to change, condense or delete any content on Discount School Supply’s website that Excelligence Learning Corporation deems, in its sole discretion, to violate the content guidelines or any other provision of these Terms of Use. Excelligence Learning Corporation does not guarantee that you will have any recourse through Excelligence Learning Corporation to edit or delete any content you have submitted. Ratings and written comments are generally posted within two to four business days. However, Excelligence Learning Corporation reserves the right to remove or to refuse to post any submission for any reason. You acknowledge that you, not Excelligence Learning Corporation, are responsible for the contents of your submission. None of the content that you submit shall be subject to any obligation of confidence on the part of, it Excelligence Learning Corporation’s agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees.
By submitting your email address in connection with your rating and review, you agree that Excelligence Learning Corporation and its third party service providers may use your email address to:
• contact you about the status of your review and other administrative purposes

• Provide details about why you liked or disliked a product
• All submitted reviews are subject to the terms set forth in our Terms of Use
We reserve the right not to post your review if it contains any of the following types of content or violates other guidelines:
• Obscenities, discriminatory language, or other language not suitable for a public forum
• Advertisements, “spam” content, or references to other products, offers, or websites
• Email addresses, URLs, phone numbers, physical addresses or other forms of contact information
• Critical or spiteful comments on other reviews posted on the page or their authors
In addition, if you wish to share feedback with us about product selection, pricing, ordering, delivery or other customer service issues, please do not submit this feedback through a product review. Instead, contact us directly.

Contest Rules

These Contest Rules apply to the Product Review & Ratings contest offered by Excelligence Learning Corporation (doing business as Discount School Supply) (“Sponsor”).
The first Discount School Supply Write-a-Review Contest begins Novemer 1, 2008 and ends December 31, 2008 and will recur quarterly until terminated by Discount School Supply. You may enter by submitting a qualified written product review as outlined in the Terms of Use. A Discount School Supply account is required to submit a review.
To Enter: Log on to www.discountschoolsupply.com and either sign in if you are already a registered customer or register with discountschoolsupply.com. Then, review a Discount School Supply on discountschoolsupply.com in accordance with the Terms of Use and you will be automatically entered into the Contest. You may review as many products as you wish and each product review will constitute one (1) entry. Product reviews that contain obscene, lewd or offensive language will be disqualified. Incomplete entries are void. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. Sponsor is not responsible for entries that are lost, late, garbled, damaged, illegible or otherwise deficient or incompletely received for any reason. Sponsor is not responsible for any typographical or other errors in offer, administration of the award or in the announcement of the prize. Sponsor, in its sole discretion, reserves the right to disqualify any person(s) tampering with the entry process or otherwise in violation of the Contest Rules. Sponsor further reserves the right to cancel, terminate or modify any promotion not capable of completion as planned, due to reasons beyond the Sponsor’s control including, but not limited to, tampering, unauthorized intervention or force majeure.
The Contest is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older as of the date of entry, except employees of Sponsor and its affiliates, subsidiaries, advertising and promotion agencies and their immediate family members and/or those living in the same household of each are not eligible. Contest is void where prohibited by law.
One winner will be selected in a random drawing held quarterly. All decisions of the judges are final. Odds of winning will be determined by the number of eligible entries received.
Prize: One (1) winner will receive a $250 gift card. All fees, federal, state and other taxes related to the use, acceptance and possession of the prize are the sole responsibility of the winner.
The winners release the Sponsor and its affiliates, officers, agents and employees from any responsibility or liability in connection with any loss, accident or death incurred in connection with the Contest. The Sponsor is not responsible for any warranty or guarantee with any prize or portion thereof. Each Winner consents to the use of his or her name and/or likeness by the Sponsor for advertising purposes without additional compensation unless prohibited by law. Prize winner may be required to sign an Affidavit of Eligibility and a Publicity/Liability Release prior to receiving a prize. These must be returned within ten (10) days after notification.
Failure to comply with the Contest Rules may result in disqualification and the selection of an alternate. SPONSOR SHALL BE DEEMED SOLE INTERPRETER OF THE CONTEST RULES. Prize is not exchangeable, transferable or redeemable for cash. By participating, entrants acknowledge and agree to be bound by the rules and the decisions of the Sponsor are final. All entries become the property of the Sponsor, who may use such entries in its discretion, and will not be returned.
